Void outside the 50 United States and where prohibited. Do not enter this contest if you are not at least 21 years of age and a legal resident of, and located within, one of the 50 United States (excluding Puerto Rico) at the time of entry.

The America’s Next Cooking Celebrity Contest begins August 18, 2008, and ends October 6, 2008. Entries must be received by 11:59 p.m., C.T., on October 6, 2008. Entries become the property of Meredith Corporation, 1716 Locust St., Des Moines, Iowa (“Sponsor”) and will not be acknowledged or returned.
ELIGIBILITY: Legal residents of the 50 United States, and the District of Columbia, 21 years of age or older, who are registered users of http://www.youtube.com are eligible to enter, except employees of Sponsor, and any other organizations affiliated with the sponsorship, fulfillment, administration, prize support, advertisement or promotion of the contest and/or their respective agents, affiliates, subsidiaries, and members of their immediate families or persons residing at the same address. To become a registered user of http://youtube.com, you must register for an account (“YouTube Account”) and agree to the site’s “Terms of Use” set forth at http://www.youtube.com/t/terms (“Terms of Use”). There is no fee or charge to become a registered user.
ENTRY: Go to www.youtube.com/betterrecipes and upload a video one (1) to three (3) minutes in length of yourself preparing an original recipe that you created. Entry materials (video and recipe) must be original (created by the entrant), unpublished and may not have previously won any award or prize. Entrants may enter multiple recipes and videos, as long as each recipe and video is unique and complies with all other terms hereof. DO NOT include music in the video submission unless you can provide documentation that you have obtained all necessary rights and clearances required to use the music from the performer, musicians, music publisher, writer and any other party with an interest in the materials used. Sponsor reserves the right to request and require entrants to submit additional materials, including a written copy of the original recipe prepared in the entrant’s video. Requests for additional materials will be made by message to entrant’s YouTube Account. No group entries.
By submitting a video for the Contest: (1) Entrant represents and warrants to Sponsor that he/she has obtained all necessary licenses, consents, waivers, releases, authorizations and/or permissions to post or transmit the entry video; (2) Entrant represents and warrants that the video does not constitute or contain any confidential information and is free of any claims of proprietary or personal rights; (3) Entrant is solely responsible for the video that he/she submits for the Contest; (4) Entrant agrees that such video is original with Entrant and that Entrant owns all right, title and interest in the video and any elements Entrant includes in the video, such as photographs, video footage, music tracks and the like (Entrant understands that Entrant may be required to provide documentation in a form acceptable to Sponsor evidencing such rights); and (5) Entrant grants to Sponsor and its affiliated entities an irrevocable, worldwide, nonexclusive, perpetual, fully sub-licensable, transferable, royalty-free right and license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, transmit, publicly perform, and publicly display such video (in whole or part) on the YouTube/Betterrecipes Channel without compensation, notification, approval or any other obligation, to anyone, including Entrant.
Sponsor reserves the right, in its sole discretion, to reject, disqualify, modify, edit, and revise any videos or related materials that are nude, obscene, defamatory, profane, offensive, lewd, pornographic, false, misleading, deceptive, or otherwise inconsistent with its editorial standards, audience expectations, or reputational interests or that Sponsor believes may violate any applicable law or regulation or the rights of any third party. Sponsor reserves the right, in its sole discretion, to verify any element of any entry or related materials and to disqualify any entrant whose participation may subject the contest, Sponsor, or Sponsor's advertisers, clients, or customers to controversy, negative publicity, scorn, or ridicule.
Sponsor further reserves the right to disqualify and remove any entry that infringes or violates any party's intellectual property rights, including, but not limited to, using third-party copyrighted materials or the names or likenesses of others without appropriate permission and attribution, using third-party trademarks without appropriate permission or attribution, and using or distributing third-party information (whether or not protected as a trade secret) in violation of a duty of confidentiality;
JUDGING: On or about October 13, 2008, a qualified panel of judges will judge eligible entries on the basis of on-camera personality of the entrant conveyed in the video (is he/she entertaining, interesting to watch and listen to?) (40%), ability of entrant to communicate the creation of the dish to the audience (40%), and recipe’s appeal to consumers (such as available and appealing ingredients; ease of preparation; appeal of prepared dish) (20%). Two (2) Finalists and ten (10) Honorable Mentions will be determined. In the event of a tie, the winning entry will be the entry among the tied entries with the higher/highest score in the criterion of on-camera personality. Potential Finalists will be notified by message to their YouTube Account, and must be available for a Cook-off in the Better Homes and Gardens Test Kitchen in Des Moines, Iowa, on October 22-24, 2008. Sponsor reserves the right to select fewer than ten (10) Honorable Mentions and/or fewer than two (2) Finalists if, in its sole discretion, it does not receive a sufficient number of eligible and qualified entries. Decisions of judges are final and binding in all respects.
COOK-OFF: The two (2) Finalists will be flown to Des Moines, Iowa, for a Cook-off in the Better Homes and Gardens Test Kitchen on October 22-24, 2008. The Finalists will each be filmed preparing one original main dish recipe created by the Finalist (not the recipe used for the video submission) using at least one of the following ingredients: pork, chicken, beef, fish or vegetables-only (non-meat). The Cook-Off will be judged by a qualified panel of judges and one (1) Grand Prize Winner will be selected based on the personality of the Finalist (is he/she entertaining, interesting to watch and listen to?) (30%); ability of the Finalist to communicate the creation of the dish to the audience (30%); final plated presentation and taste (20%); and consumer appeal of the recipe (20%). In the event of a tie, the Grand Prize Winner will be the Finalist with the higher/highest score in the criterion of personality of Finalist.
PRIZING: Ten (10) Honorable Mention winners will each receive a Sony digital camera, retail value (“RV”) $60.
The two (2) Finalists will each receive a trip package to Des Moines, Iowa, for the Cook-Off, including roundtrip coach air transportation for the Finalist from major airport nearest Finalist’s residence, approximate retail value (“ARV”) $1500.00; two (2) nights’ hotel accommodations in one (1) standard room in Des Moines, Iowa, ARV $500.00; dinner for one (1) person, two nights, ARV $100.00; and a check in the amount of $300; total trip package ARV $2,400.
The Grand Prize Winner will receive ten (10) copies of a cookbook created by Winner on TasteBook.com, awarded in the form of a TasteBook.com gift certificate in the amount of $200.00. Issuer restrictions may apply to gift certificate. Grand Prize Winner will also receive a Sony Camcorder, RV $800.
All other expenses not listed for the trips, including but not limited to, meals, taxes, gratuities, incidentals, etc., are the responsibility of the Finalists. Sponsor reserves the right to substitute prizes (or portions thereof) of equal or greater value if prizes (or portions thereof) cannot be awarded as described. Sponsor will determine all elements of prizing in its sole discretion. Prizes may not be assigned, transferred, changed or redeemed for cash, except at the sole discretion of Sponsor. Prizes are awarded “as is” with no warranty or guarantee express or implied. Sponsor disclaims all and any liability for the actual provision, quality or nature of any third party product or service accepted by the winners. The awarding of any prize is contingent upon full compliance with these Official Rules. Entrants agree to be bound by Official Rules and agree that if any winner fails to provide proof of identity, refuses to provide required affidavit, is found to have violated the Official Rules or otherwise does not meet eligibility criteria, prize will be forfeited and awarded to an alternate winner with the next highest score. Entrants understand that Sponsor is not liable for injuries, losses or damages of any kind arising from participation in this promotion and acceptance, possession and use of prize. Sponsor is not responsible for any typographical or other error in the printing of the offer, administration of the contest or in the announcement of the prize. Decisions of Sponsor are final and binding in all respects.
PRIVACY: Information collected from online entrants is subject to Sponsor’s privacy policy at www.bhg.com and www.youtube.com’s Terms of Use.
DISPUTE RESOLUTION: Except where prohibited, by participating Contest entrants agree that: All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of participant(s) and Sponsor and its agents shall be governed by and construed exclusively in accordance with the laws of the State of New York without giving effect to any principles of conflicts of law of any jurisdiction. Entrant agrees that any action at law or in equity arising out of or relating to this Contest, or awarding of the prizes, shall be filed only in the state or federal courts located in the State of New York and entrant hereby consents and submits to the personal jurisdiction of such courts for the purposes of litigating any such action. Except where prohibited, by participating in this Contest, entrant agrees that: (a) any and all disputes, claims, and causes of action arising out of or connected with this Contest, or awarding of the prizes, shall be resolved individually, without resort to any form of class action; and (b) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with participating in this Contest but in no event attorneys' fees; and (c) under no circumstances will any participant be permitted to obtain awards for and hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. Some jurisdictions do not allow the limitations or exclusion of liability for incidental or consequential damages, so the above may not apply to you.
OTHER: Sponsor assumes no responsibility for entries it is unable to process due to network, hardware or other technical failures; or any other reason, or incomplete, damaged, misdirected, or lost entries. Sponsor reserves the right, in its sole discretion to disqualify any person tampering with the entry process, the operation of the web site or otherwise in violation of the rules. Sponsor further reserves the right, in its sole discretion, to cancel, terminate or modify this promotion if not capable of completion as planned, including infection by computer virus, technical corruption, non-authorized human intervention or force majeure. In the event of cancellation, Sponsor reserves the right to select winners from among all eligible entries received prior to date of cancellation. The use of automated entry systems or any other conduct that impedes the integrity of the contest is prohibited. In the event of a dispute regarding online entry, entry will be deemed made by the holder of an established e-mail account associated with the entry.
RELEASES: Entrants authorize the Sponsor to use their video, name, voice, likeness, biographical data, city and state of residence and entry materials in promotional material and for advertising, public relations and editorial purposes worldwide, in perpetuity, or on a winner’s list, if applicable, without further compensation unless prohibited by law. Sponsor is not obligated to use any of the above-mentioned information or materials, but may do so and may edit such information or materials, at Sponsor’s sole discretion, without further obligation or compensation.
Except where prohibited by law, potential winners will be required to complete and return an Affidavit of Eligibility/Ownership/Liability Release, Publicity Release and Copyright Assignment within three (3) days of notification or the entry with the next highest score may become an alternate winner. If winner notification is returned as undeliverable, the entry with the next highest score may become an alternate winner. By participating and winning a prize, winners release Sponsor, and its parents, affiliates, subsidiaries and agencies and their respective directors, officers, employees and agents from any and all liability with respect to the prize won and participation in the contest Subject to all U. S. federal, state and local laws and regulations. Void where prohibited. Taxes on prizes are sole responsibility of winners. Finalists will be issued a 1099 tax form in the amount of the actual prize value. For winners’ names, available after December 1, 2008 send a separate, self-addressed, stamped envelope to Winners’ List, America’s Next Cooking Celebrity, 1716 Locust St., LS-335, Des Moines, IA 50309-3023. VT residents may omit return postage.
